Terms of Service

1. Introduction

These terms govern your use of Attestio, an AI-powered service for generating medical certificates and attestations. The service is provided by Lavamilk AS (org. no. 935 746 485). By creating an account or using the service, you accept these terms in full. If you do not agree to the terms, you must refrain from using the service.

Attestio is a digital tool that uses artificial intelligence to assist healthcare professionals with drafting medical certificates and attestations. The service is solely intended as an assistance tool and does not replace the practitioner's professional judgment.

The service is only available to licensed healthcare professionals with valid authorization to practice in their jurisdiction.

2. Definitions

In these terms, the following concepts have the meanings specified below:

  • The Service - The Attestio platform, including all related features, tools, and interfaces for generating medical certificates.
  • Healthcare Provider - Licensed healthcare professional using the Service, including physicians, psychologists, and other healthcare personnel with prescribing or attestation authority.
  • User - Any person who creates an account or uses the Service.
  • Certificate - Medical certificate, attestation, or other medical document generated using the Service.
  • Subscription - Paid access to the Service according to the applicable pricing plan.
  • Patient Record - Medical documentation that the Healthcare Provider uploads or pastes into the Service to generate a Certificate.

3. Healthcare Provider Responsibility

IMPORTANT: Attestio is only an assistance tool. The Healthcare Provider has full and unrestricted responsibility for all content used in patient care.

By using the Service, the Healthcare Provider confirms and accepts the following:

AI as an Assistance Tool

Attestio is solely a technical tool to streamline documentation work. The Service does not replace the Healthcare Provider's medical expertise, clinical judgment, or professional responsibility.

Review Obligation

The Healthcare Provider is obligated to read and critically evaluate all text generated by the Service before use. No generated text shall be used without thorough review.

Verification Duty

The Healthcare Provider is responsible for verifying that all medical information, diagnosis codes, functional assessments, and other content in the generated Certificate is correct and consistent with the patient's actual health status and medical records.

Compliance Responsibility

The Healthcare Provider is responsible for ensuring that the Certificate meets all relevant medical, legal, and ethical requirements, including requirements from applicable healthcare legislation and regulations.

Correction Duty

The Healthcare Provider is obligated to make necessary corrections, additions, and adjustments to the generated text before signing and submitting the Certificate.

Disclaimer

Lavamilk AS disclaims all liability for medical accuracy, completeness, or suitability of content generated by the Service. Attestio does not provide medical advice and does not make clinical judgments.

Professional Standards

The Healthcare Provider is at all times subject to applicable professional standards, ethical guidelines, and legal requirements, regardless of use of the Service.

4. Service Limitations

The Healthcare Provider acknowledges and accepts the following limitations of the Service:

  • No Medical Advice - The Service does not provide medical advice, diagnosis, or treatment recommendations. All output is based on text generation and does not replace professional medical judgment.
  • AI Limitations - Artificial intelligence may produce text containing errors, omissions, inaccuracies, or inappropriate formulations. AI models may misunderstand context or medical record information.
  • No Guarantee - We do not guarantee that generated text is complete, correct, fit for purpose, or error-free. The Service is provided 'as is'.
  • Availability - We strive for high uptime but do not guarantee uninterrupted access to the Service. Planned and unplanned maintenance may occur.
  • Third-Party Dependency - The Service depends on third-party AI providers. Changes to these services may affect functionality and quality.

5. User Terms

  • Eligibility Requirements - To use the Service, you must be a licensed healthcare professional with valid authorization in your jurisdiction. By registering, you confirm that you meet this requirement.
  • Account Security - You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.
  • Accurate Information - You agree to provide accurate and up-to-date information when registering and using the Service.
  • Acceptable Use - You agree to use the Service only for legitimate purposes in accordance with applicable law and professional standards.
  • Prohibited Use - It is prohibited to misuse the Service, including circumventing security measures, distributing malicious software, impersonating others, or using the Service for illegal purposes.
  • Personal Account - Each account is personal and may not be shared with or transferred to other persons.

6. Subscription and Payment

  • Trial Period - New users are offered a free 14-day trial period. A valid payment card must be provided at registration. The trial period provides access to all features of the Service.
  • Conversion to Paid Subscription - After the trial period expires, the subscription will automatically continue at the current monthly rate, unless you actively cancel before the trial period ends.
  • Pricing - Current prices are displayed on the pricing page at attestio.vercel.app. The standard price is 299 NOK per month. All prices include VAT where applicable.
  • Billing - The subscription is billed monthly or annually, depending on the selected plan. Payment is automatically charged to the registered payment card at the beginning of each billing period.
  • Payment Processing - Payments are handled by Stripe. By using the Service, you also accept Stripe's terms of service. Lavamilk AS does not store card details.
  • Cancellation - You can cancel your subscription at any time via account settings. Upon cancellation, you retain access to the Service until the end of the current billing period. No refunds are given for unused time.
  • Price Changes - We reserve the right to change prices with 30 days' notice. Price changes take effect at the next billing period after the notice.

7. Intellectual Property

  • Ownership of the Service - Attestio, including software, design, logos, trademarks, and documentation, belongs to Lavamilk AS. No rights are transferred to the User beyond the limited right of use that follows from these terms.
  • User License - With a subscription, you are granted a limited, non-exclusive, non-transferable right to use the Service for your own professional purposes.
  • Generated Content - Certificates and other content generated using the Service belong to you as the Healthcare Provider. You may freely use, copy, and distribute generated content in your professional practice.
  • Input Data - You retain all rights to data and content you upload or enter into the Service. We do not claim ownership of your medical records or other documents.
  • Restrictions - You do not have the right to copy, modify, decompile, distribute, or create derivative works of the Service's software or technology.

8. Disclaimer

  • Provided As Is - The Service is provided 'as is' and 'as available' without warranties of any kind, either express or implied.
  • No Warranties - We make no warranties that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that results will be accurate or reliable.
  • Medical Disclaimer - Lavamilk AS is not responsible for clinical decisions, medical judgments, or patient care based on content generated by the Service. All medical responsibility rests with the Healthcare Provider.
  • Limited Liability - Lavamilk AS's total liability under these terms is in all circumstances limited to the amount you have paid for the Service in the last 12 months.
  • Excluded Damages - We are not liable for indirect damages, consequential damages, loss of income, loss of data, or reputational damage, regardless of whether we have been informed of the possibility of such damages.
  • Force Majeure - We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, acts of terrorism, pandemics, power outages, or internet failures.

9. Termination

  • Your Termination - You may terminate your subscription and delete your account at any time via account settings or by contacting us at support@lavamilk.org.
  • Our Termination - We may suspend or terminate your access to the Service immediately if you breach these terms, misuse the Service, or fail to pay for the subscription.
  • Effect of Termination - Upon termination, your right to use the Service ends. Provisions regarding limitation of liability, intellectual property, and governing law survive termination.
  • Data After Termination - Upon termination, your account information is deleted in accordance with our privacy policy. Note that we never store patient data or generated certificates, so these are not affected by termination.

10. Privacy

Processing of personal data is governed by our privacy policy, available at attestio.vercel.app/privacy. By using the Service, you also accept our privacy policy.

No Patient Data Storage

We never store patient records, medical information, or generated certificates. All processing occurs in real-time and data is immediately discarded after generation.

GDPR Compliance - The Service is designed in accordance with the EU General Data Protection Regulation (GDPR) and applicable privacy legislation.

11. Changes to the Terms

  • Right to Change - We reserve the right to change these terms. For material changes, we will notify you via email or through the Service at least 30 days before the changes take effect.
  • Continued Use - Your continued use of the Service after changes have taken effect constitutes acceptance of the new terms.
  • In Case of Disagreement - If you do not accept the changes, you must stop using the Service and cancel your subscription before the new terms take effect.

12. Contact and Governing Law

  • Governing Law - These terms are governed by Norwegian law. Any dispute arising out of or in connection with these terms shall be sought resolved amicably. If an amicable solution is not reached, the dispute shall be decided by Norwegian courts with Oslo District Court as the legal venue.
  • Severability - If any provision of these terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Entire Agreement - These terms, together with the privacy policy, constitute the entire agreement between you and Lavamilk AS regarding use of the Service.
